क्या है Snake Venom Case मामला?
यह मामला पिछले साल (2023) गुरुग्राम में हुई एक रेव पार्टी से जुड़ा है, जिसमें कथित तौर पर सांप और उसके ज़हर (Snake and its venom) का गैरकानूनी उपयोग किया गया था। इस पार्टी को लेकर एक वीडियो और कुछ खबरें सामने आई थीं, जिनमें आरोप लगाए गए कि पार्टी में ज़हर का इस्तेमाल मादक पदार्थ (intoxicant) के रूप में किया गया।
इस मामले की गंभीरता को देखते हुए उत्तर प्रदेश पुलिस (UP Police) और वन विभाग (Forest Department) ने संयुक्त रूप से जांच शुरू की। मामले में कई लोगों से पूछताछ हुई और कुछ को हिरासत में भी लिया गया।
इल्विश यादव का नाम इस पार्टी के संभावित आयोजक के रूप में सामने आया और उनके खिलाफ एफआईआर दर्ज की गई। बाद में पुलिस द्वारा चार्जशीट दाखिल की गई, जिसमें उनका नाम शामिल था। पुलिस ने उन पर आरोप लगाया कि उन्होंने इस रेव पार्टी के आयोजन में सांपों और ज़हर के अवैध उपयोग की अनुमति दी या उसमें सहभागिता की।
इल्विश यादव का पक्ष
यूट्यूबर इल्विश यादव, जो अपने हास्य, सोशल एक्सपेरिमेंट और राजनीतिक टिप्पणियों के लिए प्रसिद्ध हैं, ने कोर्ट में याचिका दायर करते हुए कहा कि उन्हें झूठा फंसाया गया है और उनके खिलाफ कोई प्रत्यक्ष या ठोस प्रमाण नहीं है।
उन्होंने अदालत में यह भी तर्क दिया कि यह मामला उनके लोकप्रियता और छवि को खराब करने की साजिश का हिस्सा है। उनके वकीलों ने यह बताया कि चार्जशीट में इल्विश यादव की सीधी संलिप्तता साबित नहीं होती, और उन्हें केवल संदेह के आधार पर आरोपी बनाया गया है।
कोर्ट का फैसला
इस मामले की सुनवाई इलाहाबाद हाईकोर्ट के न्यायमूर्ति सुभाष विद्यार्थी (Justice Subhash Vidyarthi) की पीठ ने की। पीठ ने स्पष्ट किया कि कानून के अनुसार किसी व्यक्ति को केवल संदेह या अनुमान के आधार पर ट्रायल में नहीं घसीटा जा सकता।
कोर्ट ने अपने फैसले में कहा:
“जब तक किसी आरोपी के खिलाफ प्रत्यक्ष और स्पष्ट साक्ष्य न हों, तब तक केवल इसलिए उसे सज़ा नहीं दी जा सकती क्योंकि वह किसी आयोजन का हिस्सा था या आयोजक था। चार्जशीट में आरोपी की सीधी भूमिका या भागीदारी के कोई ठोस प्रमाण नहीं हैं।”
इसके साथ ही कोर्ट ने चार्जशीट और समन को रद्द कर दिया, जिससे इल्विश यादव को इस मामले में राहत मिल गई है।
पुलिस जांच में क्या था?
पुलिस की रिपोर्ट में दावा किया गया था कि पार्टी में जहरीले सांपों का उपयोग किया गया और कुछ सांपों को बरामद भी किया गया था। हालांकि, इन साक्ष्यों के साथ इल्विश यादव की सीधी भूमिका या उपस्थिति को जोड़ने में पुलिस असफल रही।
जांच के दौरान जिन व्यक्तियों को पकड़ा गया था, उनमें से किसी ने भी यह प्रत्यक्ष तौर पर नहीं कहा कि इल्विश यादव ने ज़हर या सांप मंगवाए थे। इसके अलावा, उनके खिलाफ कोई वीडियो फुटेज, कॉल रिकॉर्डिंग या लेनदेन संबंधी साक्ष्य भी नहीं मिले, जो उनकी संलिप्तता की पुष्टि करते।
